On Public Comment Deadline

Background

Recently, there are some twitches on the FDA public comment deadline on the "Guidance for Industry on Complementary and Alternative Medicine Products and Their Regulation by the Food and Drug Administration".  For more information on this issue, please visit

ACMA Recommendation on Public Comment Deadline

The goal of public comments is to ensure that the FDA's policy to be fair, objective, and represent the people's wishes.  It is a process of democracy.   

However, within current FDA's two or three months public comment deadline, most people are still unaware of the related issues.  Many people did not know the related issues until the issues have become law or policy and have impacted on people's lives.  

At the time when the related issues have impacted on people's lives, many people do have opinions and comments on the related issues.  However, it's already long passed the three month public comment window time.  Therefore, it is impossible to get most people's comments within the two or three month's public comment window period.

FDA is an agency for the people.  In order to represent people and the public, FDA should listen to people's voices at any time rather than just during the two or three months of public comment window time.  

Due to above reason, ACMA deems that the FDA public comment deadline should be abolished.  FDA should accept public comments any time whenever people and the public have the need to express their opinions and exercise their right of democracy. 

Democracy has no deadline.
